The Cowichan Tribes Decision: Separating Fact from Fiction and the Path Forward

The “Cowichan decision” is a landmark August 2025 British Columbia Supreme Court ruling that recognized the Cowichan Tribes’ Aboriginal title over their historic village site, Tl’uqtinus, in what is now Richmond, B.C. The ruling is significant because it contests that Aboriginal title can exist on land also held in fee simple and invalidates certain Crown grants on that land, though it does not automatically invalidate existing private property ownership. The Province of B.C., the City of Richmond, the Musqueam Indian Band and Tsawwassen First Nation have all appealed the decision.
